My Farewell Speech !

    

 

I may say here that on my visit to different places, I had requested the Judicial Officers to be more courteous, impartial and careful while discharging their duties and to expedite the matters. I had also brought to the notice of the Judicial Officers that with the co-operation of the concerned Deputy Commissioner and the Superintendent of Police, they could monitor and dispose of the cases which were pending for non-production of accused persons or for non appearance of witnesses. So also I have urged to my companion Judges to dispose of cases well in time. It has given good results. There is a steep increase in the work load on account of heavy filings due to fact that the High Court has not been working with full strength for quite some time now. Despite this, with the co-operation of brother and sister Judges, advocates and staff, we have been able to dispose of about 2.38 lakh cases as against the institution of 2.83 lack cases as 8.10.2004 in the High Court during my tenure. I am fully satisfied that in response to my constant reminders, the members of the sub-ordinate judiciary have disposed of about 25 lakh cases since 2001 upto September 2004, which is remarkable. Each one of them deserves appreciation. I offer my sincere gratitude to those who inspired, encouraged, co-operated and assisted me in discharging my onerous duties. Because of the co-operation I received from the Brother/ sister Judges sitting with me on the Bench, as also my personal staff, I was able to pronounce orders instantly, and, even in reserved matters not later than one week in any case, except two cases in two weeks. Questions of law referred to in 22 cases including connected matters were decided by the larger Benches of 5 Judges 259 cases, including connected matters, by the Full Benches and in all about 22,587 cases have been disposed of by me till 8.10.2004. Judicial Officers, members of the Bar and Staff in the sub-ordinate Judiciary have also extended their full co-operation in discharging my administrative functions effectively with satisfaction. Judicial Officers Association has taken care of the welfare of the Judicial Officers, issued Directory of Judges in 2002, and has been arranging sports meet and cultural programmes, which I have attended for three years. I wish them all good luck. I fully support them to have their own guest house and to form a Society to get land for forming a layout for Judicial Officers  .

 

It is needless for me to point out that Judges and Advocates are like members of the same family. Our functions are alike because they are all connected with dispensation of justice. An advocate discharges his duties with his best of ability and capability in the interest of his client, without having partisan attitude but as Judges, we have to apply the law on the point to the facts of each case and to discharge our duties with detachment. Credit for a judgment does not go to the Jude alone but to lawyers also, because the assistance at the Bar is directly proportionate to the quality of the judgment rendered by the Judge. Advocates are the Judges of Judges. To my mind, the combination of a healthy Bar and an upright Bench alone can ensure speedy dispensation of justice according to law in its proper perspective. Throughout my tenure here I have been saying in Court itself that the young advocates must work hard and equip themselves in a better manner. There is no necessity for me to repeat it now. I appreciate the valuable assistance given by the Advocates to me in dispensation of justice.
